some of you who have read my other posts, that i suffer with a bad back, well it has been niggling away again for a few days infact most of the time if i am honest. but i feel with the painkillers and the exercises the physio has given me i can get by. but this afternoon i was walking through the kitchen and wham a pain shot through my lower back again, this is starting to feel familar to me, and since then, i have been in shocking pain. why is it with a bad back it just hits you like this, i was once asked if i could ask for anything what would it be, well with the pain i have had in my back this year it would be a painfree day just one it would be like heaven. but enough of me wingeing, i am lucky i can still get about and still do a lot of things although not as much as i would like. but it could be worse, but you know when it happens a little more regualry i do worry. i really think what is bothering me is i put in the industrial injuries benefit as the place i hurt my back was when i was working in homecare, and they have said that i would have had a bad back within five years anyhow. but funny how they put in a hoist in that persons house afterwards, has anybody else had this sort of thing where n one would accept that something happen to some one else could have been their fault ie work situations. i just needed to say this tonight, i hope no one minds. infact maybe i should put at the top, skip this post.

Hi Crystal-rose,
My brother and his wife had a severely handicapped daughter who grew to be very heavy. It was years before they had a hoist & other suitable equipment. They both now suffer terribly with health problems related to the strain that was put upon them over the years.

i worked for social services so you would think they would look after their staff, but to put it in afterwards beggars belief. but i feel so angry that the I I B will not accept that it happened at work, i am going to appeal, but you do not usually win with these type of things

all legal complications C_R, as such, I won't comment too much, but remember that you can provide your own expert witness too, and if the conclusions conflict a court can appoint a neutral expert.
I'd also say that if they've said you'd get a bad back within 5 years anyway, then that's not good enough, and they've pretty much admitted that it's a high risk job, and high probability of hurting yourself at work - which a solicitor can present that as an acceptance of fault.
